YOU MUST BE A REGISTERED PHYSIOTHERAPIST / PHYSICAL THERAPIST (PT) OR A PT STUDENT TO ATTEND MANUAL THERAPY ACADEMY COURSES. ALL OTHER HEALTHCARE PROVIDERS MUST DIRECTLY CONTACT MANUAL THERAPY COURSES AND SPECIFY THEIR ELIGIBILITY FOR ATTENDING A MANUAL THERAPY ACADEMY PROGRAM/COURSE TO DETERMINE IF EXCEPTIONS CAN BE MADE.

ASSUMPTION OF RISKS AND ASSUMPTION OF RESPONSIBILITY
MANUAL THERAPY ACADEMY course attendees freely and voluntarily accept and assume all risks and the possibility of personal injury resulting from the attendance at the MANUAL THERAPY ACADEMY courses / programs and any other related activities during this event.

MANUAL THERAPY ACADEMY course attendees accept responsibility to abide by the laws of the country, to ensure that they have adequate medical coverage, protect personal possessions and obey all the rules set out at the courses and programs.

LIABILITY WAIVER
In consideration of approval to participate in MANUAL THERAPY ACADEMY programs, MANUAL THERAPY ACADEMY course attendees and any personal representative, hold harmless, release and forever discharge MANUAL THERAPY ACADEMY and their directors, faculty, students, volunteers, from any and all actions, causes of actions, for damages, loss or injury, resulting from or arising out of my participation in MANUAL THERAPY ACADEMY courses /programs.

MANUAL THERAPY ACADEMY course attendees also indemnify and save harmless MANUAL THERAPY ACADEMY from any and all actions, expenses or losses whatsoever which they may bear as a result of their participation in MANUAL THERAPY ACADEMY courses / programs, by reason of damage to any and all property and any and all personal injuries.

INTELLECTUAL PROPERTY OWNERSHIP
MANUAL THERAPY ACADEMY will have and retain ownership of all right, title and interest to technology and intellectual property of its courses. Nothing in these Terms and Conditions confers upon you any copyright or other intellectual property license or right. You agree that the Course Materials, Manuals, Content and the Web Site are protected by applicable copyrights, trademarks, service marks, patents or other proprietary rights and laws, all of which belong to MANUAL THERAPY ACADEMY.

IMAGE RELEASE OF IMAGES AND VIDEOS TAKEN DURING THE COURSE
You hereby grant the following rights and permissions to MANUAL THERAPY ACADEMY, its partners, and those acting with his/her authority and permission. They have the irrevocable, perpetual and unrestricted right and permission to take, use, re-use, publish, and republish photographic portraits, pictures, videos, sounds of you or in which you may be included, in whole or in part, or composite or distorted in character or form, without restriction as to changes or alterations, in conjunction with my own name, or reproductions thereof in color or otherwise, made through any medium during the course at MANUAL THERAPY ACADEMY, and in any and all media now or hereafter known, specifically including but not limited to print media and distribution over the internet for illustration, promotion, art, editorial, advertising, trade, or any other purpose whatsoever.

You specifically consent to the digital compositing or distortion of the portraits, pictures and videos, including without restriction any changes or alterations as to color, size, shape, perspective, context, foreground or background. You also consent to the use of any published matter in conjunction with such photographs and videos. You hereby waive any right that you may have to inspect or approve the finished product or products and the advertising copy or other matter that may be used in connection with them or the use to which they may be applied. I hereby release, discharge, and agree to hold harmless MANUAL THERAPY ACADEMY and all persons acting under its permission or authority, from any liability by virtue of any blurring, distortion, alteration, optical illusion, or use in composite form, whether intentional or otherwise, that may occur or be produced in the taking of such photographs or in any subsequent processing of them, as well as any publication of them, including without limitation any claims for libel or violation of any right of publicity or privacy.

INDEMNIFICATION
You agree to indemnify and hold MANUAL THERAPY ACADEMY and its Representatives harmless from any and all losses (including without limitation attorneys’ fees) resulting from any claims that may be asserted against You, You assert, or may assert, based on or relating to Your use, or the use of any individual using Your password, of the MANUAL THERAPY ACADEMY Website. You further agree to indemnify and hold Manual Therapy Academy and its Representatives harmless from any and all losses resulting from claims of third parties, including without limitation attorneys’ fees, that result in whole or in part from violations by You, or any individual using Your password, of any of the terms of this Agreement.

SEVERABILITY
If any term, clause, or provision hereof is held invalid or unenforceable by a court of competent jurisdiction, such invalidity shall not affect the validity or operation of any other term, clause, or provision, and such invalid term, clause, or provision shall be deemed to be severed from the Agreement.

SURVIVABILITY
The ownership and intellectual property rights and license provisions set forth in this Agreement, and any other provisions that by their sense and context the Parties intend to have survive, shall survive the termination of this Agreement and any obligations hereunder for any reason.

DISPUTES
This Agreement shall be governed by the laws of the State of Quebec. In the event that litigation results from or arises out of this Agreement or the performance thereof, both Parties agree to settle with a single arbitrator. The Parties agree to reimburse the prevailing Party’s reasonable attorneys’ fees, arbitration costs, and all other expenses, whether or not taxable by the arbitrator as costs, in addition to any other relief to which the prevailing Party may be entitled.
